Effectiveness Of The Post Sentence Supervision Provisions Criminology Essay This essay will examine whether the effectiveness of the post sentence supervision provisions for dangerous offenders are adequate. The changing attitude towards the treatment of dangerous offenders will be explored showing that in the twenty first century, the term dangerous offender includes sexual and violent offenders. Most public attention is focused on those who commit sexual and predatory acts against children; hence paedophiles are often associated with such dangerous people. It is a subject which has interested me particularly as the stakes are so high if things do not go to plan. My interest arose due to the adverse publicity surrounding high profile cases where dangerous offenders reoffend and it spurred me into examining whether the post sentence supervision orders worked. The term dangerous offender can also be extended to include potential terrorists, the socially excluded as well as other violent and sexual offenders who carry out offences with a varying degree of seriousness. More controversially dangerousness is also applied to the mentally ill who commit grave offences. At one time the punishment had to fit the crime and although this is still true it has to be looked at in tandem with the risk to society of permitting an offender back into the community. The Multi-Agency Public Protection Arrangements (MAPPA) arrangements were introduced to deal with those dangerous offenders who exist in the community, managing them so that they do not pose a threat to society. MAPPA is a multi agency approach consisting of the police, local authorities, schools, probation service and similar entities. What is the main aim of MAPPA; is to reform the conduct of previous offenders so that through their treatment and rehabilitation they no longer wish to re-offend; or is their aim to merely be preventative and reactionary stopping any re-offending by close supervision? The issue of releasing dangerous offenders into the community is highly controversial because the repercussions of re-offending can be horrendous. It only takes one case where another heinous crime is committed for a public outcry to ensue with the press claiming that the MAPPA system is not working. In addition the effects on the victims is acute with claims that the re-offender should not have been released early or at all, as clearly they still pose a great risk to society. Carefully balanced against the publics desire to be protected is the human rights aspect of the offender. In recent years there has been a tendency for home secretaries to get involved in what are perceived as lenient sentences given to dangerous offenders. In a couple of instances the respective home secretary has intervened to increase the recommended minimum sentence before an offender can be considered eligible for parole. The House of Lords, following an earlier decision, has recently ruled that such intervention by the home secretary is incompatible with the offenders human rights. I will use both qualitative sources with a lesser amount of quantitative material, some extracted at primary sources. Proposed chapters at this juncture are: Chapter 1 The concept of dangerousness will be explored to highlight the type of offenders under discussion. We will look at the controversial area of mentally incapable dangerous offenders and their treatment. An analysis of the legislation including relevant guidance and the views of some academic commentators will be undertaken. Chapter 2 The functioning of the multi-agency public protection arrangements will be examined in detail including a look at one particular police force. Their methodology and data will be examined to ascertain if they are successful or adequate and what is meant by adequate. Government and academic commentaries will be considered Chapter 3 Some high profile publicised cases causing concern will be examined which will lead the press and others to condemn the post supervision orders of dangerous offenders. The issue of dangerous foreign offenders committing serious offences in the UK will be examined. Chapter 4 Analysis of MAPPA data will be examined which will highlight the successes and failures of post sentencing initiatives and suggest possible reforms. Dangerous offenders have human rights and the cases of Anderson and more recently, Whiting, will be explored looking at the aspect of political intervention in minimum recommended sentences. Conclusion will tie all material together with my thoughts on the adequacy of post supervision of dangerous offenders. Literature Review A wide range of literature has been examined including secondary sources comprising eminent academic commentators and also primary sources including court judgments and published reports of the managing agencies have been examined. Other original sources under scrutiny include newspaper articles and commentaries of various public sector personnel. There is an inherent bias built into the views of the MAPPA agencies and government ministers who seek to justify the effectiveness of their respective areas of work. Chapter 1 The modern day criminal justice system in Britain is geared at the rehabilitation of offenders so the prison system is not only a means of incarceration to remove the offender from posing any danger to the public, but also a vehicle for preparing the offender for release and re-integration into society. The Criminal Justice Act 2003 (which has been amended by the Criminal Justice and Immigration Act 2008) sets out the criteria for dealing with dangerous offenders and is important to the court for sentencing purposes. Dangerous offenders are identified by reference to the commission of specified violent and sexual offences set out in Schedule 15 of the Criminal Justice Act. That Act says that a court must determine whether there is a significant risk to members of the public of serious harm by the commission by him of further offences (Criminal Justice Act, S 229). In a recent case the Court of Appeal held that in determining dangerousness the court was not confined to considering only admissible evidence and could consider, as it did in the case, an alleged history of violence although the offender did not have convictions (R v Considine and Davis, 2007). Public protection was enhanced under the Criminal Justice Act by the introduction of a sentence of imprisonment for public protec tion which ensures that certain offenders are not released until the Parole Board determines that it is safe to do so. Problems arise because although the term dangerous offender is used in a general way it is in fact extremely difficult to predict who is dangerous as individuals vary in their behaviour. Not only do individuals vary as between each other so that there are differing degrees and shades of dangerousness but also, on an individual basis, the scope for carrying out dangerous and violent acts may vary on a daily basis. The notion of dangerousness is therefore extremely complex in itself and is capable of shifting on an individual basis whereby assessing and predicting future behaviour can be compared to attempting to mould soft sand into a permanent form. Human nature can be fundamentally and inherently unpredictable even among stable law abiding individuals, so when mentally unstable people are added to the melting pot, the decision as to assessing their dangerousness becomes more complex. In the UK, policies addressing those with dangerous and severe personality disorders (DSPD) has expanded considerably in recent years against a background that people with personality disorders should not be precluded from accessing services available to the rest of society. The DSPD programme deals with patients who have the most severe personality disorders. The DSPD programme offers an intensive multi disciplinary treatment programme based on individual need and comprising a cognitive-behavioural group-based intervention approach with opportunities for social interaction, in ward-based community meetings for example. Specific treatment includes offence-specific groups, such as sex offender group and violence reduction programmes. There has been a shift of policy from placing people with DSPD in prisons into secure hospitals with the National Health Service taking a more active role in providing treatment. A smaller number of medium secure and community places have been programmed, but so far the implementation has fallen behind target and the rehabilitation of DSPD patients back into the community remains extremely challenging. Evaluation of the DSPD programme is a work in progress and the impact of this policy on reoffending rates remains to be deduced. Persons assessed as having DSPD must be detained for treatment and discharge from detention is dependent upon a test of public safety as against favourable responsiveness to treatment. The link between dangerous behaviour and mental illness remains embedded in public opinion despite the attempts of mental health practitioners to highlight the absence of such a connection. A study of public opinion towards schizophrenia found that 70% of respondents view this group as dange rous (Crisp et al, 2001). Regarding treatment in the community following release from prison or hospital, Leung cites the European judgment of W v Sweden 1988, in which compulsory medication on discharge from hospital was not a deprivation of liberty and would not impinge Article 5 of the European Convention on Human Rights (Leung, 2002). Prison population has increased dramatically over the last fifteen years from circa 43,000 at the start of the 1990s (Home Office, 2005a) to in excess of 80,000 today. Although there are numerous reasons given to explain this startling increase, the focus of the public on dangerousness is one such explanation. In 2006 a review was conducted which claimed that prison was the best place for dangerous offenders as it stopped them from re-offending (Home Office, 2006a, p. 32). In 2007 with the creation of the Ministry of Justice the preceding approach to detaining dangerous offenders for a long time did not change. On the contrary, the newly formed Ministry reiterated that prison places are available to protect the public from dangerous offenders (Ministry of Justice, 2007, p 4). The 1990s preoccupation with public protection shaped the policies of protecting the public from the risk of serious harm arising from violent offenders and the aim of responding more effectively to the risk of paedophiles and the increase in child sex abuse (Grubin, 1998) Within the UK the population is generally extremely fearful of the level of violent and sexual crime (Ditton Farrell, 2002; Kemshall, 2003). The focus on this type of crime has been exacerbated by the media and even when crime rates are shown to be falling, the public perception is that they are living in a more violent society. Dangerousness has therefore been widely used to describe an increasing amount of offences and has been accompanied with an expectation of more punitive sentences to deal with the increase. Barbara Hudson asserts that there has been a significant shift from doing justice to controlling risks as the goal of law and order and penal strategies (Hudson, 2002; p 101). The modern society is characterised by the increasing scope and influence of the mass media. The far reaching scrutiny of the global mass media means that the negatives of modern society are reported and in terms of criminal justice, its failings can be exposed. Such exposure is accompanied by cynici sm towards expert opinions and the positive effects of legislation (Garland, 2000). Garland (2001, p178) has described the space between the community and prisons as having become more strictly enforced stating that Those offenders who are released into the community are subject to much tighter control than previously and conditions that continue to restrict their freedomà ¢Ã¢â€š ¬Ã‚ ¦.the community into which they are released is actually a closely monitored terrain, a supervised space, lacking much of the liberty that one associates with normal life. Commenting on a Panorama programme broadcast in 2006, HM Chief Inspector of Probation said he thought the programme made a fair point when he said that general talk of close supervision and monitoring of offenders can give a misleading impression to the public of the extent of measures taken to prevent them (Bridges, 2007). It is clear in the early stages of this essay that there are different views on the nature and extent of monitoring to which dangerous offenders are subjected on their release from prison. Academics like Garland above consider the measures stringent, tantamount to imprisonment within the community, whereas the enforcers of those measures, probation workers, maintain that it is unhelpful to make it sound as if community service is prison in the community which it plainly is not (Bridges, 2007 p 4). Chapter 2 Violent sex offenders Once prisoners reach the end of their sentence but are still considered dangerous, measures are put in place to manage them in the community. The Violent and Sex Offender Register (ViSOR) is managed by the National Policing Improvement Agency of the Home Office. It comprises records stored on a database of those obligated to register with the police in accordance with the Sexual Offences Act 2003; those jailed for more than 12 months for violent offences and people not convicted of any crimes but who are deemed to be at risk of offending. It was rolled out to every probation area and prison establishment in England and Wales in 2008 with police, probation and prison services using the same IT system for the first time. This co-ordination should ensure that the quality and synchronisation of risk assessments are improved leading to effective interventions to prevent re-offending. In 2009 Greater Manchester Police responded to a freedom of information request under the Freedom of Information Act 2000. In complying with the request the police reported that of 16 people within their jurisdiction who were on the ViSOR since 2007, 4 had not been convicted. So 25% of those on the ViSOR had not yet been convicted of a crime in a court of law yet they were subjected to the reporting and other requirements placed on individuals who are so registered. Sexual Offences Act The notification periods for offenders are also contained within the Sexual Offences Act 2003. Where offenders are subject to imprisonment for life or for more than 30 months; imprisoned for public protection; admitted to hospital under a restriction order or subject to an order for lifelong restriction the notification period is indefinitely. The question of the legitimacy of lifelong registration has been subjected to challenge in recent years. It was successfully challenged in the High Court and the appeal against the decision was dismissed in the Supreme Court which stated that lifelong registration was incompatible with human rights (European Convention on Human Rights, Article 8). Recent Challenge and human rights The ViSOR database holds name and address records, photographs, risk assessment, offenders modus operandi, and an audit trail. The Police National Computer is linked to ViSOR. According to the National Policing Improvement Agency 77,000 records of named individuals are maintained on the database. [7] Sex offenders subject to the register must inform the Police within 3 days [8] of becoming subject to the notification requirements, or within 3 days of various changes occurring [9], including moving home, changing their name, changes of passport details. Offenders must confirm their registration annually [10]. Failure to comply is an offence, subject to a penalty of up to five years imprisonment. The importance of the ViSOR is that providing registered offenders comply with its provisions, then they can be monitored by the appropriate agencies. Although failure to comply has a penalty of up to 5 years imprisonment, this is of little comfort or assistance to people who are subjected to attacks by offenders who have failed to comply with the notification requirements. In this respect the adequacy of the registration provisions are an end in themselves and do not prevent further offending. Generally speaking the public will derive some comfort from the fact that registered offenders are on the radar of the police and are or should be at certain addresses. Problems ensue when the registered offender is not where he should be so that the supervision and monitoring duty on the agencies breaks down. Of course it may be that the offender has forgotten to register a change of address or he cannot be bothered or he has a genuine reason for not complying and that he has no intention of re-offending. The problem is that with the genuine fear of violent crime within the community, the public are alarmed if they should become aware of such failures. Even worse, if a registered offender does re-offend, the public will see this as evidence of the inadequacy of the supervisory arrangements of the ViSOR. If the non compliant registered offender does not reoffend it may be that the public is kept in oblivious ignorance and it does not come to their attention. Multi Agency Partnership Protection Agencies The MAPPA measures were put in place nine years ago in an attempt to improve the effectiveness of the management of offenders who are in the community. MAPPA has statutory force as the arrangements were first set out in the Criminal Justice and Court Services Act 2000 and re-enacted and further strengthened in part 13 section 325 of the Criminal Justice Act 2003 imposing a legal duty on agencies. The measures mainly comprise information sharing and the views of professionals who come together pooling their expertise in order to ensure the public is protected from future offending of dangerous offenders. There are 3 levels of cases under MAPPA. Level 1 can be managed by one agency (usually probation service); level 2 requires more than 1 agency and level 3 requires co-ordination among various agencies. The legal duties placed on the police, prison and probation services acting jointly as the responsible authority to establish arrangements for assessing and managing the risks posed by relevant sexual and violent offenders or other offenders who may cause serious harm to the public; to review and monitor those arrangements; and as part of the reviewing and monitoring arrangements, to prepare and publish an annual report on their operation. Other agencies also under a legal duty to co-operate with the responsible authority include local authority social services, primary care trusts, jobcentre plus, youth offending teams. Local housing providers, local education authorities and electronic monitoring providers. Thus MAPPA involves a wide range of bodies which in itself is good but the effectiveness of its measures lie in the ability to co-ordinate responses across all spectrums of the agencies by the responsible authority. In most cases the offender will be managed by the agency with supervisory responsibility but several offenders require multi-agency management and their risk management plans will be compiled and monitored at MAPPA meetings in which various agencies are present. MAPPA is primarily concerned with managing risk. David Hanson, Minister for Justice said Putting in place thorough systems to ensure high level vigilance of serious sexual and violent offenders on their release from prison is vital in our work protecting communities from crime and he also acknowledges that the introduction of the MAPPA have been successful in reducing risk (Ministry of Justice, 2008). Offenders released into the community following a period of imprisonment of 12 months or more will be subject to a licence with conditions (under the supervision of the probation service. If the offender does not comply with the set conditions, breach action will be taken whereby the offender may be sent back to prison. Sexual offences prevention orders can be made with a full order lasting for a minimum of 5 years and a requirement that the offender registers as a sexual offender. Conditions can be imposed restricting the offender from frequenting school playgrounds for example. Again if the offender breaches the order he can be taken back to court and may be imprisoned for up to 5 years. Foreign travel orders prevents offenders with convictions for sexual offences against children from travelling abroad so as to prevent children from the risk of sexual harm. In 2008, the Home Office began pilots which increased the amount of information about certain child sex offenders which was available to the public. People were able to ask for information about a person who has contact with their children. The pilots took place throughout 4 police areas and were completed in September 2009. Although the pilots were to be evaluated with a view to being implemented nationwide, regardless of the outcome of that evaluation, there is already an obligation to consider during a case review, whether there is a need to disclose information about the offender as part of the risk management plan. This would appear to be duplication and there does seem to be a necessity for MAPPAS to be seen to be continuously evolving as the offender is always one step ahead. Polygraph tests In October 2009 the Ministry of Justice announced that it was piloting mandatory polygraph tests for sex offenders in the community. The polygraph test is being scrutinised to ascertain whether it might be another useful tool for the effective management of sex offenders. The governing legislation is the Offender Management Act 2007 which authorised the mandatory use of polygraphs on sex offenders who are subject to licence upon their entry into the community following their imprisonment. The polygraph test would be used together with, and not instead of, other management offender tools. Castration Chapter 3 As can be seen there are a wide variety of management tools available under the MAPPA arrangements but their effectiveness and adequacy will now be examined. In October 2009 the Daily Telegraph reported that dangerous foreign criminals are remaining in Britain despite strenuous efforts by the Government to remove them. The paper reports that immigration judges have overturned attempts by the Home Office to remove at least 50 foreign criminals from the country in the past year with their defence lawyers arguing that deporting them would breach their human rights. Examples of such cases are Mark Cadle from Berlize, jailed for having sex with a 14 year old girl who judges said would have his human right to family life infringed if deported because his family lived in Britain. A Somali who had been convicted for manslaughter and robbery was allowed to remain in the country after the court said he would be at serious risk of persecution if deported as he was from a minority clan. Of the 50 cases involved 15 include criminals with convictions for serious violent crimes, 4 sex offenders and 13 with drug convictions. In most of the cases lawyers argued that deporting them would breach their human rights to a family life because many had families in Britain. In some instances like the Somali case, the issues were that the person would be subjected to torture if returned to his homeland in breach of Article 3 of the European Convention on Human Rights. On the 2 November 2009 the bleak headlines of the Guardian newspaper read probation service failing to learn lessons over murder of French students, inquiry finds (Travis, 2009). In 2008 two French students were tortured and murdered in London by Dano Sonnex. He was found guilty of their murder and was a violent drug addict who was meant to be under supervision and should have been in jail as he had earlier breached his conditions for release. The case raised fresh anxiety and concerns over the manner in which dangerous offenders are monitored in the community. The parents of the two students were so infuriate that they were preparing to issue proceedings against the probation service and the police. The massive public outcry prompted the chief inspector of probation, Andrew Bridges to look at 276 cases across 10 London boroughs. The findings did not make palpable reading for the relevant MAPPA responsible bodies. Bridges said that the results were disappointing particularly when com pared to 2008 and he deduced that only 54% of the public protection work examined was of sufficiently high level of quality we were looking for. ( ). In 2008 the figure was 63% for the whole London sample so this heralded a poignant deterioration. Another high profile case was the murder of Naomi Bryant in Winchester by Anthony Rice. Rice had served 16 years in prison and had committed several sexual attacks including rape and attempted rape. At the time of the murder he was on life licence and was under the supervision of Hampshire Probation Area alongside numerous other agencies via MAPPA. Following the murder of Bryant an independent report was undertaken which concluded that there were serious shortcomings in the way Rice had been managed prior and since his release from prison. The report revealed that the failure to properly manage Rices risk of being a danger to the community was not the fault of one particular person or agency but was a collective failure of measures both within the prison and the community. Upon his release there was no clear indication of who took the lead responsibility for Rice and there followed transfers of key responsibilities which made for inconsistencies and lack of co-ordination. The conditions on the Licence were vague; for example one condition stated that Rice should not misuse substances and the hostel staff where he was staying interpreted this as meaning that he could consume alcohol. The report criticised the MAPPA panel for allowing them to be distracted by human rights consideration at the expense of public protection. The report highlighted lack of communication and errors of judgment and reinforced the importance of the three responsible agencies having clarity and consistency in their practices and procedures. The next notorious case concerns the murder of John Monckton and the attempted murder of his wife by 2 young men both under the supervision of London probation. When Hanson was 17 years old he received a sentence of 12 years for attempted murder and conspiracy to commit robbery, and it was during his licence period for this offence that he committed the murder of Monckton. Hanson ought to have been referred to MAPPA but he was not, despite being assessed as a high risk of causing harm. So despite being branded as a high risk he was not treated as such. The parole board failed to appreciate the relevance of Hansons predeliction for using instrumental violence and his recorded included utilising violence for financial advantage. Hanson was placed on a CALM programme which does not address this type of violence. After his release he was to report to an office which was within the exclusion zone from which he was banned; clearly a mistake. His residency was also an issue resulting in him living in a hostel which had not been approved by the parole board because the approved hostel in Essex had refused his application. The interpretation of licence conditions caused problems and the risk of harm posed was not assessed or managed adequately and there was a lack of co-ordination with the partnership arrangements. The inspectorate report concluded there was a collective failure to describe the failure in practices of all those managing Hanson and White and acknowledged the considerable organisational constraints in their management (HM Inspectorate of Probation, 2006) Positive Aspects There are however some positive aspects to the work of MAPPA (HM Inspectorate of Probation, 2006). The report decided that in the vast majority of cases MAPPA had been very effective and produced good work although there was still room for improvement. The report concluded that the risk of harm assessments had been accurate in a high proportion of cases. The probation and prison services worked closely in order to identify appropriate offender programmes and appropriate tools were activated to manage the risk of harm posed by particular offenders. The public protection arrangements which existed in 2001 and found wanting (Maguire et al 2001) had greatly improved by 2005. In 2001 apart from the probation and police few of the other agencies bothered to attend meetings. The introduction of the Criminal Justice Court Services Act 2000 had made real and major improvements to the management of high risk cases. In 2005 most agencies were attending meetings and recording decisions and the evidence used to reach their conclusions with all areas having regular case reviews and information sharing protocols in place. Procedures were in place to manage offenders at all the levels including appropriate risk classification tools and gate keeping through the system. However resources were a problem as were the IT case management systems. The most recent version of this romantic comedy was done by Michael Hoffman in 1999. This portrayal follows very closely to the original play. Very few lines are taken out, and the characters stay very true to the assumed original idea. The one main difference in the original play and this movie is the depiction of the character Nick Bottom the weaver. The original play shows Bottom as the â€Å"†¦overconfident weaver†¦hilariously overt†¦has extraordinary belief in his own ability†¦totally unaware of his ridiculousness†¦Ã¢â‚¬  (Sparknotes.com). These types of characteristics would normally make readers see Bottom as a cocky, egotistical, center of attention, â€Å"ass†. In the play, this is the case. However, in the 1999 movie version, with Kevin Kline as Bottom, the audience gets a different idea of Bottom without changi ng his basic character traits. Hoffman achieved changing the overall perception of the character of Bottom from to a â€Å"†¦warm fuzzy man, a dreamer for whom we can root†, and pathetic lover, while still keeping the â€Å"ass† quality, by only changing a few small, very subtle things (Jones, 127).   Ã‚  Ã‚  Ã‚  Ã‚  In what would be Act I Scene II of the original play, Bottom is shown sitting alone at a cafà ©. As he is making his way to leave, a rough looking woman walking around in a very hurried and determined manner become the focus of the screen. The audience soon realizes this is Bottoms wife. Bottom seems to become frightened of her on sight, so he hides behind a wall. You also learn that his wife thinks his dreams of being an actor are simply unrealistic and stupid. The original Shakespearian play does not include a wife for Nick Bottom. The adding of a wife to a movie is not normally of great importance; however, the type of wife she is makes all the difference. Later in the scene, when Bottom goes home, the audience sees more of what type of a wife this is. As Bottom enters his house he is shown looking around to see where she might be; he is very quite and slips into a room quickly. Almost instantly, his wife realizes he is home, and she rushes into the room with a very ugly, stern expression on her face. There is no speaking in this scene (Hoffman).

Ferdinand de Saussure and Onject of Study: a Brief Illustration Essay

Ferdinand de Saussure was a Swiss linguist who laid the foundation on the ideas of structure in the study of language. His Book Course in General Linguistics that was published in 1916 has detailed all that he claimed to be his views. In his book Saussure shows us a clear reaction against many of the ideas raised and he emphasizes the importance of seeing language as a living phenomenon as against the historical view, of studying speech, of analysing the underlying system of a language in order to demonstrate an integral structure, and of placing language firmly in the social milieu. Saussure’s theoretical ideas are a must read and his influence has been unparalleled in European Linguistics since and, it had a major formative role to play in the shaping of linguistic thoughts in Europe. Saussure’s Object of Study theorised his structuralist view of language and shows how his essay forms the basis of structuralist theory. Saussure equipped his essay with a theory and a method of linguistic analysis from the structuralist point of view. Saussure envisaged langage to be composed of two aspects- the language system and the act of speaking. Langage is that faculty of human speech that is present in all human being due to heredity, and it requires the correct environmental stimuli for proper development. It is our facility to talk to each other which Saussure has infused in his work. Saussure also argues strongly that the characteristics of the system of language are really present in the brain, and are not simply abstractions. It is something which the individual speaker can make use of but cannot affect by itself. It is a corporate and social phenomenon. Saussure in the very beginning of the essay claims that the linguistic study cannot be judged from the study of other sciences. Linguistic study is completely a different process. In linguistic a particular object of study may have several series of different things- the sound, the idea, the derivation- to light up after study. Hence Saussure says that the object of study cannot be at the first to the view point. It is the viewpoint that creates the object of study. The linguistic phenomena can be always found in bi-complimentary facets which are dependent on one another. That is, the perception of the ear of the articulated syllables as the auditory impressions cannot be the sounds in questions that come to be existed with the vocal organs. Speech sound is no equal to language and they do not exist independently and are mere instruments of thoughts whereas, language is completely an individual aspect. Saussure emphasis on these two distinctions comes at this point of his analysis. The language system as Saussure admits should be studied independently. He cites the example of Dead language that even though it is no longer to be spoken, however, we can acquaint to its linguistic structures. The language is incongruous and its systems are of similar nature. The language is a structured system and it differs from speech. Saussure has cited a example of a man who has lost his power of speech can also grasp the language system through vocal signs by which he can understand. Saussure in his essay discusses the linguistic structures as only to be a part of language even though it is an integral part of it. The structure of a language is both the social product and the body of necessary conventions adopted by society to enable members of society to use their language faculty. It comprises in various domains and it is purely physical, psychological and physiological. It is for the individual and for the society. The language faculty of the both rest upon the structure of the language and there cannot be a proper classification for that as such language has no proper distinctions. The linguistic structures are that faculty in the study of language by which the articulating words, natural or not, are put in use only by means of linguistic instruments that are created and provided by society. The language itself is a structured system and a self contained whole and principle of classification. Saussure in his essay mentions the role of speech circuits of how speeches are exchanged from one individual to another. He gave a proper illustration of it with a proper diagram. This he calls purely a physical process. In order to understand this tract one must leave the individual act, which is merely language in its young stage, and he proceeds to consider it a social phenomenon. If done so all individuals will linguistically link among themselves and all individuals will reproduce whether it may or may not be that exact but will be almost the same signs related to the same concept. Saussure says that the language cannot be the function of the speaker but it is a passively registered product of the individual whereas, speech is the act of the will and of intelligence of the individual. In his essay, Saussure also speaks about the evolution of language from times. There are some words which are rarely spoken in our daily contemporary word and usage of such words in our day to day life is kind of absurdity. So Saussure argues that language and linguistics goes on evolution from time to time. It is an institution of the present and of the past at any given time. Saussure also notes on the sciences that claims to language as falling under their domain. But Saussure says that their methods are different and are not as it were needed. He says that the linguists should only take up his primary concern in studying language and to manifest all other concerns with it. Saussure also speaks about the question of the vocal apparatus and he says it a secondary one in comparison to language. Linguists disagree to the notion about the vocal apparatus and it is not clear that the vocal apparatus is solely made for our speaking as that our legs are made for walking. Saussure cites the example of Whitney who regards this vocal apparatus is that we uses for our linguistic purposes. The contribution of Saussure in the concept of language system is the main theoretical contribution and many linguists feel that it was this facet of his thought which had the most profound influence on subsequent scholarship. His view of a language as a system of mutually defining entities is a conception which underlay his works to philology. It is fundamental to his account to his structure in language. Any sentence, for Saussure, is a sequence of signs, and each signs contributes something to the meaning of the whole, and each contrasting with all other signs in the language. The sign, for Saussure is the basic element of a language. A sequence of a syntagmatic relationship- which is a linear relationship between the signs are present in the sentence. The sign is the basic unit of communication and it is a mental construct. Saussure accepted that there must be two sides of meaning that posits a natural relationship between words and things. His labels for the two sides were signifier and signified, one which the thing which signifies and the other the thing that is signified. It can also be taken as the concept and the acoustic image. The signified is thus always omething of an interpretation that is added to the signifier. He calls this relationship a linguistic sign. This linguistic signs are not abstractions, although they are essentially psychological. Linguistic signs are, so to speak, tangible and writing can fix them in conventional images, whereas it would be impossible to capture the acts of speech in all their details. When we say signified, this do not exist in sensible form, it is a thought and creation of mental image that the signifier has signified. Saussure’s main concern is linguistic sign does not link a name and a thing; instead it links a concept and an acoustic image. That is, language is more than just a list of terms that correspond to things. An acoustic image is the mental image of a name that allows a language-user to say the name. However, a linguistic sign links signifier and signified. A signifier is the sound we say when we say an object, and the signified is the concept of that said object. The said object is the sign. In Saussure’s theory of linguistics, the signifier is the sound and the signified is the thought. The linguistic sign is neither conceptual nor phonic, neither thought nor sound. Rather, it is the whole of the link that unites sound and idea, signifier and signified. The properties of the sign are by nature abstract, and are not concrete. He says that the linguistic principles operate on two principles. The first principle is that the linguistic sign is arbitrary as there is no interior link between the concept and the acoustic image. The second is that the signifier being auditory in nature unfolds in time only. When the signifier and the signified are joined together they produce a sign which is of positive order, and concrete rather than abstract. The idea of structuralist theory has achieved the status largely on the account of Saussure Object of Study which made it the major linguistic theme of the later years after his death. The linguists were also much influenced by the notions of Saussure, although less directly. The essay forms the basis of a concept of language as a vast network of structures and systems was emphasised on the syntagmatic relationships of the Saussurean emphasis in structures which was taken as the keynote of a number of theories of language and which underlies many other linguistic approaches to language. The central tenet of structuralism is that the phenomena of human life, whether language or media, are not intelligible except through their network of relationships, making the sign and the system (or structure) in which the sign is embedded primary concepts. As such, a sign — for instance, a word — gets its meaning only in relation to or in contrast with other signs in a system of signs. All My Sons Play by Arthur Miller

The story described how a woman informed on her father who had sold faulty parts to the U. S. military during World War II. Jim Bayliss – Jim is a successful doctor, but is frustrated with the stifling domesticity of his life. He wants to become a medical researcher, but continues in his job as it pays the bills. He is a close friend to the Keller family and spends a lot of time in their backyard. Sue Bayliss Sue is Jims wife: needling and dangerous but affectionate, she too is a friend of the Keller family, but is secretly resentful of what she sees as Chriss bad idealistic influence on Jim. Frank talks about a horoscope for Joes son Larry that he is compiling for Kate Keller, Joe’s wife. Jims wife, Sue, and Franks wife, Lydia, each make brief appearances. Ann Deever, the Kellers former next-door-neighbor, has come to visit the family and is asleep upstairs. While waiting for her, Joe and Chris talk about Larrys memorial tree, which has blown down during the night. Larry was reported missing during World War II and is presumed dead, as there has been no contact with him for more than three years. Kate clings to the hope that he will come back, but Chris feels that it is wrong to keep up such a pretence for her. Bert comes by to play jail with Joe and runs off to patrol the neighborhood. Chris admits to his father that he wants to marry Ann; however, Ann was Larry’s girlfriend before he served in World War II, and since Kate does not believe Larry to be dead, Ann is still technically Larrys girl. By marrying Ann, Chris is effectively pronouncing Larry dead, so Joe fears that Kate will object to the proposal of marriage. Kate emerges and describes her nightmare from the evening before; it is about Larry falling from his plane and crying her name. She objects when Chris tells her that the family should try to forget Larry. Kate admits to Joe that she is suspicious about why Ann has come to visit; she tells him that she knows that Ann believes with her that Larry is still alive, and tells Joe that he must keep believing also. Bert reappears, but is harshly banished by Kate. When Ann finally comes down, everyone talks about how beautiful and mature she looks, and the family engages in smalltalk until Kate asks Ann if she is still waiting for Larry. Ann says that she is not, and realizes for the first time how deeply Kates hope runs. It is revealed that Steve Deever, Ann’s father, is serving time for the deaths of 21 pilots who crashed over Australia due to the faulty cylinder heads shipped out by the Keller/Deever factory in 1943. Keller insists that it was Steves crime and recalls how he successfully appealed against his conviction for the crime while Steve remained in prison. Keller reacts strongly to Anns conviction that her father is guilty. Ann has refused all contact with her father since Larry was reported missing, and insists that her fathers actions may have related to Larrys death. When Chris and Ann are left alone in the yard, they reveal their love for each other; however, Ann senses that Chris seems somehow ashamed, and asks him to tell her about it so their relationship can be an honest one. Chris recounts his experience of losing his company during a battle in the War. He is still angry that at home, life has continued as normal, and this affects his ability to accept the gift of having Ann. Joe emerges and tells Ann that her brother George is on the phone from Columbus. Joe tells Chris that he mustnt feel ashamed of the family money; then Ann comes out and reveals that George is coming back to the house after visiting his father in prison for the first time, and Joe is clearly worried. [edit] Act II As they come out, Chris is removing Larrys fallen tree and the family is inside getting ready for dinner. Kate confides in Chris Kellers concern that George may bring up the case again, and says she wont live through it if he does. Ann emerges and is met with Kates acerbic wit and Chriss assurance that they will tell her of their marriage plans tonight. Sue Bayliss interrupts Anns solo reverie by searching for Jim, and they share a drink of juice. Sue asks Ann to move away from the area if she and Chris marry because Chris’ idealism is negatively affecting her husband Jim. Jim had always wanted to become a medical reseacher but never followed through because Chris idealistic ideas kept him from doing so. Sue implies Joes guilt and insists that Chris and everyone else know something about it. Ann defends Chris, saying that he wouldn’t take money out of the plant if there was anything wrong with it, but she becomes disturbed because Chris told her that the case was all forgotten. Chris reassures Ann by telling her he wouldn’t be able to forgive his father if he had murdered the pilots. Anns faith in Chris is restored, and they and Joe share conversation in the yard. Joe offers Steve a job for when he gets out of jail, but Ann insists that Joe owes Steve nothing and Chris refuses to have him at the plant. Jim enters, having gone to pick George up from the train. He warns Chris and Ann that George is angry and should be driven somewhere to talk, a proposition which Chris promptly refuses. A loud argument ensues, in which George tries to convince Ann that Chris knows Joe is guilty, having allowed his father to take the blame for shipping the damaged parts, and Ann is caught between the two men that she loves, unable to make them reconcile with each other. Kate enters, causing Chris and George to halt their argument; she is extraordinarily happy about seeing Georgie and pacifies him enough to settle everyone down for a time. Keller then enters; George reluctantly greets him. Then Lydia emerges and her past relationship with George is then revealed. Lydia has had three children and shows George the life on which he missed out while he was serving in World War II. Ann goes inside to call a cab for George, having insisted that he must leave on the next train and not start a fight. Keller asks George about Steve and then argues that throughout Steve’s life he never took responsibility for his own actions, so he must be guilty now. Just when it seems that George is convinced and he agrees to stay for dinner, Kate tells him that Keller has never been sick in fifteen years, thereby disproving Kellers earlier alibi that he had the flu on the day that Steve allowed the cracked heads to be shipped, and was not able to come to the office. George latches on to this slip of the tongue and begins to interrogate Joe. Frank rushes in with Larrys finished horoscope and asserts that the day Larry was supposed to have died was his favorable day and he must therefore be alive somewhere in the world. Kate believes him unhesitatingly and tells Ann that she packed her bag and that Ann must leave with George. Ann insists that she will stay until Chris tells her to go, and reluctantly tells George to leave, running after him to try to make amends. Chris tries to insist that he will marry Ann, but Kate finally tells him that if Larry is dead, Joe killed him. Chris understands this to mean that Joe was guilty of shipping the faulty parts. Which means that Joe would have been responsible for Larrys death. Keller at last admits his guilt, but justifies his actions saying that if he had done it for his family. And if he went that day the factory would have been shut down and he would have lost money needed to support his family. Chris rejects this explanation, telling Joe that his responsibility to his country sometimes outweighs that to his business and family. Chris storms off, leaving Joe worn out and heart brokenly guilty. edit] Act III Kate waits on the back porch for Chris- he took the car six hours before and has not come back yet. Jim enters and consoles Kate before the entrance of Joe. Ann has stayed in her room for those six hours: having seen Chris storm out of the house, she now knows the truth about Keller’s gui lt. Joe insists that Chris just doesnt understand what responsibility for family means, and that Larry knew better what the business was all about. Joe tells Kate that he did it all for her and their two sons. When Ann emerges, she asks Kate to tell Chris that she knows Larry is dead, so that Chris will no longer feel ashamed about his love for Ann. Kate still insists that Larry is alive; Ann insists that she loved him and wouldnt have even considered marrying anyone else if she werent sure hed died. Finally, Ann asks Joe to go into the house and produces a letter that Larry wrote her the day he died; she tells Kate that she didnt bring the letter to hurt the family, but both are devastated by the final destruction of Kates hope. Chris returns and tells Ann and Kate that he is going away to Cleveland to start over; he rejects Ann when she begs to go with him, saying that he can no longer bear to look at his father but can also not bring himself to send him to prison as he deserves and therefore is not a moral and strong enough man for her. When Joe enters, he confronts Chris and they argue about Joes guilt. Ann rushes forward and gives Larrys letter to Chris; Kate tries to take it away from him and to prevent Joe from hearing it, but it is too late. Chris reads the letter aloud: it describes how, upon learning about the investigation into the incident and his realization of his fathers guilt, Larry couldnt bear to live anymore; he told Ann that he knew hed be reported missing and that she mustnt wait for him. All realize that Joe was responsible for Larrys death: Although Larrys plane did not have a cracked cylinder head in it, Larry found out that his father was not the kind of man he thought hed been. He took his own life by crashing his plane during a mission rather than face the disillusionment he could now see through. On hearing this news, Keller goes inside the house to get his jacket and turn himself in; but while Chris and Kate argue about sending him to prison and Ann watches the results of the letter unfold, a shot is heard. In these plays the tragic hero or protagonist will commit an offence, often unknowingly, which will return to haunt him, sometimes many years later. The play encapsulates all the fallout from the offense into a 24 hour time span. During that day, the protagonist must learn his fault and suffer as a result, and perhaps even die. In this way the gods are shown to be just and moral order is restored. In All My Sons, these elements are all present; it takes place within a 24 hour period, has a protagonist suffering from a previous offense, and punishment for that offense. Additionally, it explores the father-son relationship, also a common theme in Grecian tragedies. Ann Deever could also be seen to parallel a messenger as her letter is proof of Larrys death. The Greek plays, and those of Shakespeare two thousand years later, are about kings, dukes or great generals, because at that time these individuals were thought to embody or represent the whole people. Nowadays, we do not perceive the upper classes as most representational. When writers want to show a person who represents a nation or class, they typically invent a fictional â€Å"ordinary† person, the Man in the Street or Joe Public. In Joe Keller, Arthur Miller creates just such a representative type. Joe is a very ordinary man, decent, hard-working and charitable, a man no-one could dislike. But, like the protagonist of the ancient drama, he has a flaw or weakness. This, in turn, causes him to act wrongly. He is forced to accept responsibility his suicide is necessary to restore the moral order of the universe, and allows his son, Chris, to live free from guilt and persecution. Arthur Miller later uses the everyman in a criticism of the American Dream in Death of a Salesman, which is in many ways similar to All My Sons. [edit] Themes [edit] Responsibility, Society and the Generation Gap The play focuses on Joe Keller’s conflict of responsibilities, his responsibility to his family and that to wider society. He originally believes that he is justified in sending cracked cylinder heads and causing the deaths of 21 pilots, as this allowed his family to make money and allowed his son Chris to inherit the family business. Keller justifies his actions as he thinks he has a higher obligation to his family over society, to Keller there is nothing greater than the family Im his father and hes my son, and if theres anything bigger than that Ill put a bullet in my head! and Miller criticizes what he would consider a myopic world view. The major theme of All My Sons is Arthur Miller’s belief that people have a wider responsibility to the society in which they live, and this is something that Chris, Joes son, is aware of and believes in. Unlike his father, Chris feels society and other people play a main part in a persons responsibility, as when he finds the truth out about his fathers actions; he is horrified What the hell are you? You’re not even an animal, no animal kills his own, what are you? What must I do to you? I ought to tear the tongue out of your mouth, what must I do? and here it is possible Chris has become a sort of spokesperson for Arthur Miller in the play. Keller seems to still not understand his sons anguish, as his responses are Chris my Chris Not until Larrys letter is revealed to him, does Keller finally see the point of view of the next generation. Only after hearing Larrys letter does he reply to Chris question Do you get it now!? with Yes I think I do and then lead into where the plays title comes from when Joe Keller eventually realizes that they were all my sons in one sense. Keller kills himself in the final few pages of the play, leaving Kate on her own, the one thing she has always been said to fear, but the truth seems to give her a sort of strength in itself, as she tells her hysterical son Chris in the last line of the play, to live forget now live finally freeing him of the obligation of living with any feeling of responsibility for Kellers suicide. Joe Keller, a representative type who would be considered an ordinary American, has lived through the Depression and despite a lack of education he has been able to own a factory, which he hopes his son will inherit. However, Keller’s quest for money leads to his responsibility for the deaths of 21 American pilots. Keller has apparently achieved the American Dream he lives in a comfortable house despite being an uneducated man. Miller is emphasizing the hollowness of the American Dream and that one should think about the consequences of our actions. However, this material comfort which Keller has worked to provide his family with the very best is of little consequence. His strong family unit is an illusion his wife is ill, Chris is discontent and Larry has committed suicide as a result of his fathers narrow-minded and reprehensible decision. It is through the letter from Larry that Keller realizes that he has not only killed one son but all of his sons, a theme which is reiterated by the title of the play. In conclusion, the American Dream has become more like an American Nightmare. Chris shows moral responsibility while his father Joe shows intense family responsibility. [edit] Wartime Profiteering Another theme of All My Sons is wartime profiteering. As there were large contracts when America entered the war on two fronts, the conditions were created for what Arthur Miller described as profiteering on a vast scale. Chris Keller is particularly angry that his selflessness in fighting in the war is contrasted by the selfishness of those making money off the war. [edit] Death Death is another key theme in All My Sons. Kate Keller refuses to accept her son’s death. She denies the possibility of this death for a long time. Recognizing the death of her son would mean that she recognizes that her husband was responsible. This is an issue that constantly weighs on Kate throughout the work. The tree is a symbol that represents that Larry is still alive, and when the tree gets knocked down Kate still refuses to believe that her son is in danger. When Chris finds out his father is responsible for killing the 21 pilots, he replies I was dying every day and you were killing my boys and it is very notable Chris refers to the pilots as his boys and says I was dying every day; making them closer to himself and trying to indicate to the audience the extent of which he feels he has moral obligation to society.

This changed in the 1940s when Paris began to recover its position as the world’s acclaimed fashion hub. By the 1950s Paris had almost regained back its position and by the 1970s, the nation had fully regained its international fashion acclamation. Today, both the United Sates and Paris continue to compete in the world’s fashion although Paris continues to outdo the United States. The connection between art and fashion gained exceptional closeness in the 1920s. In order to gain ideas and encouragement, designers hooked up with artists. As a result of new developments in art such as Art Deco, Futurism, and Surrealism, art and clothing were blended into fashion. Original artistic designs were brought to clothing, mainly due to the influence of Futurism and Surrealism, and cooperation with innovative artists. Suoh points out that â€Å"the decorative accessories and textiles of Art Deco emerged from this rich collaboration, which included the adaptation of a number of artistic techniques such as Oriental lacquering†.... Wealthy customers of haute couture fashion suddenly lost their wealth, as homeless people crowded the streets. Some people in the middle class society managed to survive the Great Depression, but they preferred to do their sewing from home. As a result of the economic hardship, more natural forms of clothing and fashion replaced the ideal and strong silhouette that was popular in the 1920s (Suoh, 2002). For evening wear, the culture of long dresses was revived, while hair regained a soft curl and a more conventional feminine length. â€Å"The slim line of clothing remained, but the bosom was reasserted and the waistline was once again nipped into a standard position† (Suoh, 2002, p. 335). However, fashion for casual activities gradually gained importance, as people wore favored sports items and clothing and regular dresses with short skirts. Female and male designers acclaimed in the 1920s began to experiment and exploit new materials, while new designers expanded their clothi ng lines to include outfits for different occasions. These styles remained dominant until the beginning of the Second World War. Fashion and Art and the Second World War The Second World War which broke out in 1939 brought serious damage to art and fashion (Suoh, 2002). Many couture houses and salons in Paris closed, while the few that remained suffered from the departure of clients and scarcity of materials.
